摘要
推进环境监管的数字化,促进《环境保护法》的良善化、精细化,迈向更加智慧化的环境治理体系与治理能力现代化,是新时代环境监管体制改革和强化环境法现代性品格的重要使命。因此,大数据时代环境法治建设要及时回应高水平推进共同富裕示范区建设的环境空间正义诉求,破解法律规则供给不足或碎片化以及传统官员晋升逻辑导向下的科层制所引发的监管效能低、短期化等弊病。当前,政府数字化转型与综合行政执法改革对环境监管体制及其制度体系的完善提出了更高要求。针对现有法律规定不利于数据运用、监管执法力量专业化程度低、区域科技水平参差不齐等问题引发的法治困境,建议从环境监管的法规范体系、生态环境和自然资源大数据智慧管理系统建设入手,加强监管规范化、监管精准化、监管制度化和监管均等化等方面的制度体系建设,推动环境监管从"政策驱动"迈向"法律驱动"、从信息化迈向数字化智慧化、从部门本位迈向大成集智和整体智治的三大历史性转型。此外,还要通过数字法治体系的构建来破除对数字化、智慧化治理的一些迷信和迷思,提高环境公共数据治理能力和环境监管的法治权威,避免"既当运动员又当裁判员"的法治困境,从而达成环境保护的空间正义、公平正义等实质法治。
Promoting the digitalization of environmental supervision,making the standardization and refinement of the Environmental Protection Law,and moving towards a more intelligent environmental governance system and modernization of governance capabilities are important for reforming the environmental regulatory system in the new era.In the era of big data,the environmental rule of law needs to reveal,respond to,and crack the insufficient or fragmented supply of legal rules,as well as the low efficiency and short-term supervision caused by the bureaucratic system under the logic of traditional official promotion.The current digital transformation of the government and the reform of comprehensive administrative law enforcement have put forward higher requirements for the improvement of the environmental supervision system.At present,there are some legal dilemmas,such as the legal provisions are not conducive to the use of data,the low degree of specialization of supervision and law enforcement force,and the uneven level of regional science and technology.It is thus recommended to start with the construction of legal system for environmental supervision and smart management system for big data of ecological environment and natural resources,to strengthen the establishment of an institutional system in terms of standardization of supervision,precision of supervision,institutionalization of supervision,and equalization of supervision,etc.It further promotes the three historical transformations of environmental supervision from“policy-driven”to“law-driven”,from informatization to digital intelligence,and from department-based to integrated overall intelligence.In addition,through the construction of a digital legal system,some superstitions and myths about digital and intelligent governance should be eliminated,the ability of environmental public data governance and the legal authority of environmental supervision should be improved,and the paradox of“being both an athlete and a referee”should be eliminated,so as to achieve the substantive rule of law and justice for environmental protection.
