摘要
在国际货物买卖中 ,货物的风险转移直接涉及买卖双方的切身利益 ,它关系到是由卖方还是由买方承担损失的问题。因而 ,明确货物风险转移的具体时间和条件有着重要的实际意义。本文主要通过将我国《合同法》有关买卖合同风险转移的条款与《联合国国际货物销售合同公约》的对应条款的比较 ,指出了我国《合同法》
In the international sales of goods, the passing of risk concerns the vital interests of both the seller and buyer directly. It relates to whether the seller or the buyer should bear the loss. Therefore, it is of important practical significance to clearly indicate the concrete time and condition of the passing of risk. The paper mainly points out the defects of the relevant articles in our country's contract law by way of making a comparison between the articles related to the passing of risk in the sales contracts of our country and the corresponding articles in the United Nations Convention on Contracts for the International Sale of Goods.
