摘要
腐败治理是新时代党和国家所面临的重大课题,运用法治防控腐败是破解治腐难题的关键。法治反腐的把握需要全面考量治理腐败的目的、依法治国的战略背景等要素。本文在厘清法治反腐涵义的基础上,提出应从理顺法治与反腐的关系、完善党纪与国法的衔接、健全治腐机构与机制的设计、确立预防与惩治并重的体系四个方面破解法治反腐所面临的问题与挑战,进而推进反腐败斗争走向决定性胜利。
Anti-corruption is a major issue the party and the country face in the new era. Using the rule of law to prevent and control corruption is the key to solving the problem. The practice of using the rule of law against the corruption requires a comprehensive consideration of the purpose of controlling corruption and the strategic background of ruling the country by law. Based on clarifying the meaning of using the rule of law against the corruption,this paper proposes that we should straighten out the relationship between the rule of law and anti-corruption, improve the connection between the party's discipline and national law,complete the design of institutions and mechanisms for anti-corruption,and establish the system which lays equal stress on both prevention and punishment in order to solve the questions faced by using the rule of law against the corruption. We can then win a convincing victory in the battle of anti-corruption.
