摘要
人工智能是收集、整理海量信息并进行计算机分析的技术,因而在一开始就可能复制大量他人享有著作权的作品。这些作品的使用(尤其是商业目的使用),并不必然可以援引现行著作权法的合理使用规定而豁免。如此一来,企业为开展人工智能领域的研究必须对大量作品的复制而支付许可费用。这不仅在实践中不可能完成,也会严重阻碍我国在该领域的科技进步。与此同时,现有著作权法修订草案所提供的合理使用原则性条款也无法为人工智能发展过程中的作品合理使用提供确定性。在美国、日本和欧盟等国家或地区已经提供或正在讨论提供合理使用解决方案的情况下,为扫清人工智能发展的著作权障碍并提供国际相对竞争优势,我国有必要通过修法提供专门的著作权限制与例外。同时,为了防止该例外的扩大化适用对著作权人产生不合理的损害,仍须科学界定该例外的具体适用情形。
Artificial intelligence is the latest technology that collects and manages a sea of data.It may also copy a large number of copyrighted works.The copying of these works,especially for commercial purpose,does not necessary fit into the current copyright limitations and exceptions,and therefore may have to be approved by copyright holders.As a result,enterprises must pay a large amount of fees for many such copies in the process of carrying out AI research.However,paying every single work copied in AI research not only is impossible to achieve,but also will crash even the leading IT companies in China.Meanwhile,the proposed general fair use clause would not provide predictable outcome for such copying.Given that the United States,Japan,and the European Union have already provided or are going to provide specific exceptions for such copying,it is necessary for China to also provide specific copyright limitations and exceptions for such copying,so as to clear the copyright obstacle for the development of the AI industry and gain a comparative competition advantage in the global market.However,the concrete application of these new exceptions should be scientifically defined so as to limit its application and prevent it from causing unreasonable harms to the legitimate interests of the author.
