摘要
美国通过立法与司法判例保护和限制作者的版权,创造性地丰富作品"合理使用"情形,实现了作品版权保护与知识流通的平衡。相较于美国,我国在图书馆版权"合理使用"方面差距明显,为此,本文建议我国应完善作品版权"合理使用"的规则,设立适应科技发展的数字版权细则,在司法方面保护图书馆的公共性服务职能,弱化图书馆过度承担的版权责任。
The United States protects and restricts the authors copyright through legislation and judicial precedent, enriches the sit- uations of work ＂fair use＂ creatively, and realizes the balance of work copyright protection and knowledge circulation. Compared with the United States, the gap of the copyright ＂fair use＂ of Chinese library is obvious. To this end, China should improve the ＂fair use＂ rules of copyright, establish digital copyright rules to adapt to the development of science and technology, protect the public service functions of library in judicial aspects, and weaken the excessive responsibility faced by library.
