摘要
长江经济带生态环境的法治化治理是长江经济带健康发展的重要保障。从实然维度看,长江经济带生态环境治理法治化建设受制于生态治理的碎片化,在流域执法、生态立法和环境司法三个方面呈现“分割”格局;从应然维度看,这种“分割”格局在理论和现实两个层面均具备“衔接”转型的可能性;从可然维度看,长江经济带生态环境治理法治化应实现在立法上从单独立法向综合立法,在执法上从区域管理向流域治理,在司法上从模式变革向体系构建,在参与主体上从治理排他向多元共治的衔接转型。
The governance of ecological environment by legalization is a very important guarantee for the healthy development in the Yangtze River Economic Belt. As for the dimension of reality,the governance of ecological environment by legalization in this region has already been confined by the fragmentation of governance of ecological environment, leading to the emergence of segmentation in the following of three directions,the administrative enforcement of environmental law,the legislation of protection,and the environmental justice. Under the analysis of imperative,the segmentation has the possibility and necessity to break through the corner of theory and practice. As for the dimension of path,the whole process in the legalization of the governance of ecological environment should realize the following steps:from separated legislation to synthetic legislation,from local management to basin management,from the innovation of justice pattern to the construction of system,and from the exclusive administration to joint administration.
