摘要
《美国残疾人法》的"Eligibility criteria"等重要概念及其在典型判例中的运用具有可借鉴的价值。我国反残疾就业歧视立法保护中应引入"适格标准""工作核心内容""适度调整"等核心理念,取消用人单位按比例招录残疾就业人群的强制性义务,赋予残疾人员享有司法救济权,同时在《残疾人保障法》中补充不得拒录符合"适格标准"等的条件残疾人群的相关内容,并明确关于遭受残疾人就业岐视的举证责任。
Such important concepts as “eligibility criteria” in American Disabilities Act and their adoptions in typicalcases are of great referential value. China should introduce such core ideas as “eligibility criteria”, “core work”,“moderate adjustment” into the legislation about anti disablility-discrimination, cancel the mandatory obligation of theemployer recruiting the disabled in proportion, grant the disabled the just right to access relief, add such relativecontents as rejecting qualified disabled by “suitable standards” to the Protection Law for the Disabled, and clarify theburden of proof with regard to employment discrimination suffered by the disabled.
