摘要
非法证据排除规则在证据史上具有进步意义 ,它体现了对人的尊重。从程序正义和实体正义两方面考察 ,该规则都是有价值的 ,其价值大于成本。为了增加其价值 ,降低其成本 。
The exclusionary rule has progressive value in the history of evidence,manifests the respect for human being,and has rationality in itself.The rule is valuable in procedure justice and substantive justice, and its value is more than its cost.With a view to increasing its value and decreasing its cost,attention should be given to both the general justice and the justice in concrete cases.
