摘要
“人权”口号是伴随着资产阶级登上历史舞台而问世的。资产阶级的“人权”理论经历了一个从萌芽、启蒙到形成、成熟的历史发展过程。中国罪犯人权概念的提出与发展 ,既是同西方国家进行人权政治斗争的现实需要 ,又是中国监狱行刑现代化的必然结果。罪犯人权的基本内容包括公民权利、政治权利及经济、社会和文化权利。对罪犯的人权保障既要注重权利内容的完善 。
The slogan of 'human rights' came out with bourgeoisies stepping on the stage of history. The bourgeoisie theory of 'human rights' has experienced a historical development from sprouting and enlightening to formulating and maturing. The concept of human rights of criminals in China is both the realistic need of political struggle with the western countries in human rights and the inevitable result of the modernization of Chinese prison execution of punishment. The human rights of criminals in China include the civil rights, political rights and economic, social, cultural rights, etc. To protect the human rights of criminals we ought to concern not only about the rights perfected but also the legal rights realized.
