摘要
电子行政行为法的研究有利于智能电子政务发展,作为行政法的核心范畴,具体行政行为已不局限于半自动化,实务中出现了完全由机器作出的全自动具体行政行为。具体行政行为的成立要件中包含行政机关的意思表示要素,而机器无法作出意思表示。在不确定法律概念和裁量情形下,因探寻个案正义的必要,全自动化可能意味着违反法治国原则。信息时代,行政程序正从个案程序演变至集团程序,诸多程序性权利面临被机器行政架空的威胁。我国立法缺失相关规定,可从德国和欧盟的立法例中吸取有益经验,在特别法中补充对全自动具体行政行为的规范,以提升公民电子信任为目标,平衡电子政务发展和公民的权利保护。
The research on the E-Administrative-Action brings benefits for E-Government. As the central concept of administrative law,the administrative act is not limited to half automation,but the full automation of the administrative act occurs in practice. However,machine cannot form human wills. In the case of the indeterminate legal concept and the discretion,the automation violates the rule of law,because the balancing in individual cases is necessary. In the information society,the single procedure becomes a mass procedure,which can lead to the exacerbation of procedural rights. China can learn useful experience from Germany and the EU to determine the fully automated administrative act in legal regulations. With the balance between the development of E-Government and legal protection,digital consumer confidence would be increased.
