摘要
对网约车行业司机与平台企业之间的劳动关系认定,需要以了解和尊重行业实际用工现状为基础,并考虑网约车新政对市场发展走向的影响。我国目前网约车的用工模式并非典型的分享经济业态,可区分为司机以自有车辆加盟的C2C模式和平台公司提供车辆的B2C模式,两种模式下又存在司机兼职与全职加盟之分,以及"四方协议"与"公司自营"模式之分。不同的用工形态会直接影响劳动关系的认定和未来规制的思路和方向。
The identification of labor relations between the driver and platform enterprise of ride-hailing industry,need to understand and respect the actual situation of industry employment,and consider about the influence of the ride-hailing New Deal for the market development trend.China's current employment model of ride-hailing is not a typical sharing economy,which is divided into the C2C model for drivers to provide vehicles and the B2C model in which platform companies have their own vehicles.In these two modes,there are also parttime and full-time joining of drivers,and the division of"four-party agreement"and"company self-operation"mode.The different employment forms will directly affect the identification of labor relations and the direction of future regulation.
