摘要
不同的身份意味着不同的权利、义务和责任。与提供劳务相关的法律关系当中,劳动者较之受雇者、受雇者较之普通合同当事人,所受到的保护有着明显的不同。我国现代职业院校的学生经常因为实习、勤工助学、兼职而参与到社会劳动当中,如何认定他们的劳动身份,对他们的权益保护有着非常重要的意义。由于年龄整体偏小以及社会阅历的不足,学生群体本身就是弱势群体的代名词,所以他们在学校总能受到各种的优待。当他们走向社会,法律制定者和实施者应当不断纠正制度与观念之间的偏差,尽量将他们纳入到特殊保护群体的范畴,以避免其合法权益受到不正当地侵害。
Different identities mean different rights, obligations and responsibilities. In the legal relationship withthe provision of labor services, the workers are significantly different than those who are employed, and the sameas the employed compared to the ordinary contract parties. Because of practice, the vocational college studentsoften fall into part-time jobs, then how to protect their rights and interests has very important significance. Due tothe small age and the lack of social experience, the student groups themselves belong to the disadvantagedgroups, so they can always receive a variety of preferential treatment in school. When they go to society, the lawmakers and implementers should constantly correct the deviation between system and regulation, include theminto the category of special protection group, and protect their legitimate rights and interests from damagingimproperly.
