摘要
法律在促进企业经济活力与加强对劳动者权益的倾斜保护之间,如果偏重于后者,按照传统劳动法对劳动关系的调整模式从严规制劳务派遣活动,其效果可能适得其反。现行立法以贯彻"三性"原则为目标限缩劳务派遣的用工范围,以落实"同工同酬"待遇保护被派遣劳工的工资权益,以"共同雇主"理念下的连带责任承担来加强对被派遣劳动者的权益保护,均有失妥当。法律规制手段的选择,应将对劳务派遣机构的市场准入作为重点,完善对劳务派遣活动的有效监管和对违法行为的严厉制裁,应正确看待用工单位对派遣用工的弹性化需求与派遣劳动者的职业稳定性之间的关系,不能把传统劳动法对工厂制下正规就业劳动者的劳动权利保护体系无差别地移植适用于被派遣劳动者,不能擅自扩大"共同雇主"的范围以加重用工单位的法律责任承担。
The generation and legalization of labor dispatch,various economiy,legal factors in the process of the economic development of a country influence each other.Its prosperity in the labor employment market,is related with labor market structure change and the adjustment of the economic structure in China labor supply.Between promoting enterprise economic activity and strengthen the protection of laborer's rights,if law lay particular stress on the latter,its effects may be counterproductive according to the concept of the labor relationship adjustment to strictly regulate labor dispatch activity. The choice of legal regulation means should focus on market access of dispatch mechanism,and improve the effective regulation on labor dispatch activity and law system construction of sanctions for violations. The existing legislation implements the principle of"three properties"as the goal to narrow the range of labor dispatch,implements the "equal pay for equal work"treatment for protection of the dispatched workers interests,and strengthen the protection of the rights and interests of the dispatched workers.Social effects of the regulation are not the return of the traditional labor contract form under the conditions of dispatching shrink,but triggered a new round of legal regulation.
