摘要
随着信息时代来临,手机已成为生活必需品。手机短信继报纸、广播、电视、互联网之后被人们称为"第五媒体"。但手机短信业务日趋繁荣与法律监管空白渐显,为滋生垃圾短信提供了空间。这不仅侵害消费者合法权益,而且损害了市场经济正常秩序。随着垃圾短信侵权频发,亟待填补如垃圾短信法律概念界定、立法规制缺失、部门监管不力、违法成本较低等诸多法律漏洞,全方位对垃圾短信进行法律规制,建立长久有效的惩罚性赔偿机制,以便于规制市场秩序,构建有序的法治社会。
With the advent of the information age,mobile phones have become necessities of life.Short messages of mobile phones are known as the ＂fifth media＂after the newspaper,radio,television and internet.For the increasingly prosperous SMS business and the blank legal regulation,spam messages are breeding,which not only against the legitimate rights and interests of consumers,but also damage the normal order of the market economy.Therefore,with the frequent infringement of spam messages,it is urgent to fill the legal loopholes in the definition of spam messages,lack of legislative regulation,weak departmental supervision,low legal costs and so on.This requires all-round legal regulation of spam messages and to establish the long-term effective mechanism of punitive compensation,in order to regulate the market order and better build an orderly rule of law society.
