摘要
生态特区的建设关键在于能否构建法治之"特",其体制机制之特既依赖于法治之"特",也须转变为法治之"特";生态特区的生态文明建设根本上依赖于法治,生态特区之生态文明先行先试须以生态法治为根本保障。生态法治是生态特区应当借鉴的外国生态文明建设的典型经验和成功手段,生态特区在生态文明建设中肩负着探索和完善我国生态法治的重要使命。当下,我国生态特区构建生态法治之"特"的条件已基本具备,因为我国在生态文明建设中已经积累了一定的生态法治的成功经验,而特区立法权也为生态特区的生态法治之"特"提供了充分的立法可行性。
The key to the construction of the special ecological zones is the construction of the specialty of the laws.The specialty of the special ecological zones depends on and should be turned into the specialty of the laws.Basically speak- ing,the construction of ecological civilization in the special ecological zones relies on the laws,so the early and pilot implementation of the ecological civilization in the special ecological zones must be based on the ecological laws,which is the typical experience and successful means in the construction of ecological civilizations that should be learned from foreign countries by the special ecological zones.In terms of the construction of ecological civilization,the special ecolog- ical zones have an important mission as to the exploration and improvement of the ecological laws in our country.Cur- rently,there have been favorable c;onditions for the special ecological zones constructing the specialty of ecological laws because our country has accumulated certain successful experience in ecological civilization.Besides,the power of legisla- tion in the special zones has also provided enough legal feasibility for the specialty of ecological civilization.
