摘要
在刑事审判活动中采用远程视频审判方式,在一定程度上节约了诉讼成本,提高了诉讼效率。但这种方式不利于实现直接原则和审判公开原则,不利于对被告人的教育感化,在技术上也无法保障信息安全,从根本上不利于保障刑事速裁程序的公正性。因此,远程视频审判方式的运用应当严格限制在刑事速裁程序的案件范围之内,并且还应当在尊重当事人意愿、遵守审判公开原则、加强技术保障和提高审判人员素质的基础上谨慎推行。
To some extent,the video criminal trial saves ligigation cost,reduces the risks of escorting,and increases ligigation efficiency. However,the video trial goes against the principle of direct trial and disclosure,is not good for the education and influence on the defendants,and is lack of technical security. All in all,the video trial can not guarantee the fairness in criminal rapid decision procedure. Therefore,it should be limited in some cases of criminal rapid decision procedure,at the same time respect for the defendants,and abide by the principle of disclosure. The video trial should be used on the basis of technical security and the improvement of judges' quality.
