摘要
在疫情防控等重大突发公共卫生事件中,刑事司法应坚守法治原则,充分发挥刑事司法应对疫情防控的引领作用。公安机关应完善突发事件刑事立案体系,加强行政执法与刑事司法的衔接,慎重使用查封、扣押、冻结措施,以有助于企业发展和疫情防控。检察机关应确立有效的办案工作机制、积极发挥检察监督和公益诉讼职能,同时应在审查批捕和起诉方面发挥认罪认罚从宽的作用。人民法院需创新网络司法服务,贯彻宽严相济的刑事政策,发挥司法能动性。纪检监察机关查处防控疫情渎职犯罪时应充分发挥渎职行为的纪法衔接机制,依法把握相关渎职犯罪的罪名适用。
In major public health emergencies such as epidemic prevention and control,criminal justice should adhere to the principle of rule of law and give full play to the leading role of criminal justice in responding to epidemic prevention and control.Public security organs should improve the criminal filing system for emergencies,strengthen the interface between administrative law enforcement and criminal justice,and carefully use seizure,seizure and freezing measures to help enterprise development and epidemic prevention and control.The procuratorial organs should establish an effective mechanism for handling cases,actively play the functions of procuratorial supervision and public interest litigation,and at the same time,they should also play the role of confession and clemency in the examination and prosecution of arrest and prosecution.The people’s court needs to innovate the network judicial service,implement the criminal policy of leniency and strictness,and give full play to the judicial energy.When investigating and controlling the crime of malfeasance in the epidemic,the discipline inspection and supervision organ shall give full play to the mechanism of linking the discipline law of dereliction of duty and grasp the application of the relevant crime of dereliction of duty in accordance with the law.
