摘要
口供证据补强规则是指对证明力明显薄弱的、能够证明案件全部事实或主要事实的有罪口供,要求有其他证据予以证实才可以作为定案依据的规则。口供证据补强规则由被补强的口供范围和对象、用以补强口供的证据、补强证据的证明程度四个方面构成,当内在构成达到完善的程度时,口供证据补强规则就能够发挥保障口供真实性、防止误判和防止过分倚重口供、保障人权的功能。但是,我国的口供证据补强规则存在很多问题。在理论上,对被补强的口供范围和对象、用以补强口供的证据、补强证据的证明程度等规定不明确。在实践中,缺乏适用口供证据补强规则的指导和标准。基于口供证据补强规则存在的问题,应当从明确被补强口供的范围、明确口供补强的对象、明确用以补强口供的证据、明确补强证据的证明程度四个方面完善口供证据补强规则的内在构成。
The rule of oral confession reinforcement refers that the oral confession of guilt is obviously weak, which can prove that all the facts or main facts of the case, and require other evidence to prove that it can be used as the basis for a final decision. The rule of oral confession reinforcement consists of four aspects： Firstly, the scope of the supplementary confession. Secondly, the object of the supplementary confession. Thirdly, the corroborative evidence. Fourthly, the degree of corroborative evidence.When the internal structure reaches the perfect degree, the rule of oral confession reinforcement is able to guarantee the authenticity of oral confession, prevent the miscarriage of Justice, prevent the excessive reliance on oral confession, and protect the human rights. However, the rule of oral confession reinforcement encounters varieties of problems in China. In theory, the provisions of the supplementary confession’s scope and object, the corroborative evidence, the degree of corroborative evidence are not clear. In practice, the rule of oral confession reinforcement’s guidance and standards are lacking.In view of the rule of oral confession reinforcement’s problems,we should improve the internal structure of the rule of oral confession reinforcement from four aspects： Firstly, clearly defining the scope of the supplementary confession.Secondly, clearly defining the object of the oral confession reinforcement. Thirdly, clearly defining the corroborative evidence. Fourthly, clearly defining the degree of corroborative evidence.
