摘要
随着修复性司法在各国刑事司法实践中的不断加强,我国环境司法领域也正在引进修复性司法理念并尝试进行本土性的改良。生态修复性司法理念弥补了原有环境司法中只注重惩罚不注重激励、只注重保护不注重修复的弊端,并借助制度的顶层设计,推动生态文明建设,以实现美丽中国梦。目前,我国生态修复性司法制度的实践类型主要有政府运行模式、法院运行模式和第三方市场运行模式。对三种运行模式从理论及实践角度进行深入分析,可以发现完善我国生态修复性司法制度的现实路径,以期实现修复性理念在环境司法领域的改良与构建。
Restorative justice is being admitted in the criminal judicial practice and applied to worldwide.In China,restorative justice idea has also been introduced and localized to the environmental justice field. The purpose of building ecological restorative justice in China is to better realize the good governance of the construction of ecological civilization society. The traditional environmental justice pays attention to the judicial punishment while ignoring incentives,and attaches importance to protection while overlooking restoration,but such defects can be corrected by adopting the concept of ecological restoration justice,which can meet the realistic request of realizing the rule of law in China. At present,the regime of constructing the ecological restoration of the judicial system in China has three main modes,namely,the government operation pattern,the courts operation mode and the third party market operation mode of three. The paper deeply analyses the theoretical basis and current situation of the development of these three modes so as to set forward the realistic routine of perfecting the regime of ecological restoration justice and to promote the sound development of ecological restoration justice in China.
