摘要
手术同意书签字主体范围涉及患者、家属或关系人、法定代理人或授权委托人、近亲属、医疗机构等。本文以医疗实务中手术同意书签字主体与法律规定签字主体存在冲突为切入点,研究手术同意书签字主体在医疗实务中存在的问题,从立法的视角提出法律应契合医疗实际,从统一且扩大各法律规定中手术同意书签字主体的范围、确定侵权责任法中近亲属的范围及签字顺序、明确医疗机构负责人签字的具体情形等方面进行自我修正。
Signature subjects of operation consent agreement include patients, family members or related parties, statutory agents or authorized trustees, immediate relatives and medical institutions, etc.. Focusing on the conflict between the signature subject in medical practice and the signature subject according to legal regulations, this paper studies the problems that exist in the practice of medical practice, and suggests from legislative per- spective that laws should fit into medical practice, and should be amended from the following aspects： unifying and expanding the scope of signature subjects of operation consent agreement, determining the scope of immediate relatives and signing order in Tort Liability Law, making clear the specific situation of the signature of the head of medical institutions, etc..
