摘要
非标准劳动关系是相对于标准劳动关系而言的一种特殊形式的劳动关系。在我国非标准劳动用工主要有两种形式:一、非全日制用工;二、劳务派遣。该制度设立之初的目的在于满足劳动者和企业灵活的务(用)工需求以及降低企业的运营成本,但是随着制度的实施,学界对于制度设计理念以及具体实施效果产生了不同的看法。本文在总结了学界主要理论争议点的基础上,从研究劳动立法目的的角度出发,对非标准劳动关系研究进行综述。
The non-standard employment relation is a kind of special labor relation compared to the formal employment. There are two main types of the non-standard employment relationship in our country: part-time employment and labor dispatching. At the beginning of the establishment of the system, the non-standard employment is to meet the workers and enterprises flexible demands and reduce the operating costs of enterprises. But with the implementation of the system, scholars have different views on the legislative purpose. Based on summarizing the main different theoretical points of the academic circles, this paper makes a review of the non-standard labor relations from the point of view of the legislative purpose of labor law.
