摘要
当前诸多对于农村留守儿童问题探讨的论著很大程度上是从教育、心理健康、个体安全与监护、社会化困境等视角进行的研究。当我们从法学的立足点出发,提取出"留守儿童权利"这一研究客体并置放于"弱者权益保护"的视域下进行深度剖析与探究,这将利于我们将农村留守儿童问题提升到人权和基本权利的高度来进行认识与对待。无疑,此举将为农村留守儿童问题的解决提供全新的"权利路径"。
At present, many researches on the problems of left-behind children in rural areas are from the perspective of education, mental health, personal safety and guardianship, and social dilemma. When we set out from the standpoint of law, pick out the research object of the rights of the left-behind children,and then place in the perspective of the rights and interests of the disadvantageous to analysis and explorate.This will help us to raise the issue of left-behind children in rural areas to the hei3ght of human rights and fundamental rights to recognize and treat.There is no doubt, the move will provide a new solution to the problem of rural left-behind children in a right path.
