摘要
环境公益诉讼可以为公众参与环保提供法制化途径,对弥补政府环境监管的有限性、震慑环境违法行为,以及预防环境污染和生态破坏具有重要作用。环境公益诉讼的发展与环境治理转型是一个同步的过程,环保社会组织参与、生态环境市场化治理和评估等贯穿环境公益诉讼的各个环节,环境治理转型是环境公益诉讼的基础和前提。环保社会组织发展水平低、环境治理市场机制不完善是当前环境公益诉讼发展面临的主要瓶颈,未来应培育引导环保社会组织的发展、建立第三方环境鉴定评估体系、构建环境修复治理市场化机制,推动环境公益诉讼深入发展。
Environmental public interest litigation can provide a legal way for the public to participate in environmental protection.It plays an important role in making up for the limitation of government environmental regulation, deterring illegal behaviors and preventing environmental pollution. Environmental governance transformation and environmental public interest litigation should develop simultaneously. Public participation in environmental protection and market-oriented environmental management run through all aspects of environmental public interest litigation, while environmental public interest litigation postulates environmental governance transformation. The backwardness of social environmental organizations and the flawed market mechanism for environmental governance are major bottlenecks of environmental public interest litigation. Further development of environmental public interest litigation should include cultivating and guiding social environmental organizations, establishing a third-party environmental evaluation system, building up a market mechanism for environmental remediation, and promoting the further development of environmental public interest litigation.
