摘要
确立区分原则是妥当处理无权处分的基础。由于以往我国的法律思维中缺乏对物权变动与原因行为的区分 ,所以 ,无权处分的否定后果往往落在作为原因行为的合同之上 ,造成利益的扭曲。
Forming different principle is the base of dealing with 'no' right treatments property.As our thinkings in laws lacked difference about its rangings and behaviors.So it would result in profitable distort because its 'no' result would be on the contracts as behaviors of results.I think that we should give up abstract principle and rdfarm the theories of 'no' right treatment under the nost important model on public effect.
