摘要
文章认为,应坚持农户的主体地位。农户是由享有实际承包土地资格与实际土地分配份额的集体经济组织成员构成的组织,其成员须为集体经济组织成员,且须具有发包方分配的土地。农户成员不等同于集体经济组织成员,亦不等同于家庭成员;农户不等同于农村家庭。土地承包经营权系农户所有,成员按份共有,承包土地系家庭成员合伙经营。
Peasant household is a civil subject according to the law that members of the collective economic organizations conclude a contract and manage, members of the organizations should be members of the collective economic organizations, and have land from the collective economic organizations, hence, we should uphold the dominant position of peasant. Peasant household is not equivalent to rural households; members are not equivalent to family members. The land contractual management rights are hold by peasant household; the members are co-owners by share, family members co-manage the contractual land.
