摘要
人大代表构成的广泛性,直接关系到人民当家作主权利的实现,关系到人大制度作用和优越性的发挥。在当前一些地方,特别是基层人大代表选举中,出于代表结构比例考量,基于部分代表多重身份而出现身份选择不合理、甚或"失真"现象,掩盖了代表结构失衡问题。代表身份选择不合理,既伤害了人大代表选举的民主性,也损害了本应有的广泛代表性,不利于代表结构的优化,不利于人大制度的成长。为杜绝人大代表身份选择不合理、甚或"失真"的问题,需要正确处理人大代表选举中代表性与民主性的关系,正确认识选举人大代表与遴选精英、英雄模范、标兵的区别,培育和提升广大选民参加人大代表选举的积极性和能力,尊重选民和代表联名推荐代表候选人的权利,规范候选人确定环节,完善当选代表信息统计和公开制度。
Broad representation of deputies to NPC is directly related to the realization of the people’s democratic rights and the superiority of the people’s congress system. But at the present, in some areas, especially at the basic level of people’s congress election, there exist some unreasonable phenomena as the imbalance in the structure of deputies because of the deputies’ multiple or even fake identities. The unreasonable phenomenon of the choice of deputies’ status has damaged the democracy and representativeness of deputies’ election of NPC, harmful not only to the optimization of the structure but also to the healthy growth of NPC. To eliminate the problem of irrational status choice, we need to handle correctly the relationship between representativeness and democracy in the election of deputies to the people’s congress, to understand rightly the difference between the deputy to the NPC and the elite, to enhance the enthusiasm of voters to participate in elections, to respect the rights of the candidates recommended by the voters jointly, and to perfect the information disclosure system.
