摘要
中国当前的现代大学制度不够完善,政府在大学治理中有过度介入的倾向。改革政府和高校之间的关系已经成为高等教育持续健康发展的需要。章程作为大学的"治理宪法",对建立现代大学制度和厘清政校关系具有重要的价值。通过纵向研究和横向对比,从法学和教育学的角度研究章程的外部关系要素,以期对政府与大学关系的改革提供启示和参考。
The relation between government and university is a matter of great concern in the construction of the modern university system in China. The role of the government in the university management should be considered from the perspective of historical reason and legal environment. The university statute is of gre^t value in clarifing the relation between the government and university. From analyzing the elements of the statute＇ s external relations vertically and laterally, some suggestion are provided for the reform of the relationship between government and university. K
