《联合国海洋法公约》与中国海洋权益问题研究

摘要 《联合国海洋法公约》存在文本缺陷,它没有对一些具体事项给出明确答案,没有对一些重要概念进行解释,没有对海洋划界给出可操作性指导。正是因为《公约》存在的这些,在现实中,作为南海和东海争端声索方的中国面临关于西沙群岛基线、九段线的质疑,也使中国有无权利对专属经济区内的美国军舰的军事活动进行管辖引发中美间热议。中国应立足自身是《公约》成员国这一基本立场,依法捍卫主权和安全利益,谋取在九段线等问题上诉求的合法性,并提倡在具体问题领域的国际合作。
