摘要
在我国,由于土地所有制度的二元性,无论学术界还是政府层面对征地补偿标准的本质并没有认识清楚,从而导致当前我国征地补偿价格测算方法的非市场性,进而不能满足公正补偿的要求,引发较多的征地冲突。在厘定清楚征地补偿标准本质的基础上,从土地估价方法的角度探讨了以剩余法和市场法来测算征地补偿价格的思路,并发现,市场化程度较高的测算方法测算的征地补偿标准明显要高,从而更有利于被征地农民的利益保障,并从根本上减少征地冲突。
In our country,due to the dual land ownership system,both academic and governmental understanding of the nature of land expropriation compensation standard is not clear,leading to nonmarketable measurement to calculate land expropriation compensation price,which cannot meet the requirements of fair compensation,and causes more conflicts of land expropriation.This paper firstly set clear the nature of land expropriation compensation standard,and then discussed the residual method and market approach to calculate the price of land expropriation compensation from the angle of land appraisal methods.It found that the land compensation standards measured by marketable measurement were significantly high,thus more conducive to safeguard the interests of landless peasants,and radically reduce land conflict.
