摘要
国际投资法律机制正从多极体系向多中心结构变化,逐渐脱离当前国际投资法律体系的发展中国家增多,发达国家正积极推动超大型自由贸易协定。此趋势的规则表现是国际投资法律机制从欧美两极化主导下的双边机制向多中心国家主导的多边化方向发展。我国应有应对不同场所下多边投资规则构建的方略,即在遵循优先构建地缘性多边投资规则、重点构建自贸区多边投资规则、主导构建非发达国家间多边投资规则、积极参与构建普遍性投资规则的基本方略基础上,对规则冲突进行协调。
The legal mechanism of international investment is changing from a multi-polar system to the multi-hub structure.The number of developing countries that move away from the current international investment legal systems is increasing,while developed countries are trying to promote the formation of mega-regional agreements.It manifests that bilateral regime which is led by bipolarity has been evolving to multilateral regime which is led by multi-hub states.China should adopt different strategies for different regimes：the priority of making geopolitical multilateral investment rules,focusing on the construction of the FTA multilateral investment rules,leading the construction of multilateral investment rules of the non-developed countries,actively participating in the construction of the universal investment rules,and coordinating conflicts of these rules and relevant rules.
