摘要
逮捕是刑事诉讼活动中最为严厉的强制手段,适用恰当可以惩罚犯罪,保护受害者,维护社会稳定,促进刑事诉讼程序的顺利进行,而适用错误将伤及无辜,侵害相关犯罪嫌疑人、被告人的合法权益,侵害人权。因此,在司法实践中正确适用逮捕措施,对提高逮捕工作质量,至关重要,而正确适用逮捕措施的前提是准确理解和适用逮捕条件。
Arrest is the most severe coercion in criminal lawsuit activity, appropriate apply would punish crime, protect the victims, maintain social stability, promote the smooth implementation of the criminal procedure. But the application of the error would hurt inno- cent and infringe upon the lawful rights and interests, relevant criminal suspect or defendant violate human rights. Therefore, correctly ap- plying the arrest measures in the judicial practice could improve the quality of arrest, vital, and correctly applying the arrest measure is the premise of accurate understanding and applicable conditions of arrest.
