摘要
土地登记制度既是土地管理制度特别是地籍管理制度的重要组成部分,又是物权法的重要制度基础。随着市场经济的不断成熟,权益保护意识的提高,以及不动产统一登记的提出,现今的土地登记制度已经不能适应社会发展的需求,急需进一步完善。本研究以福州市各类土地的登记现状及统一登记的相关准备工作情况进行分析,论证了以土地为基础的统一登记制度优势,根据其存在的问题,从统一登记范围、统一法律依据、统一登记机构、数据更新、人才队伍建设等方面探讨符合本地实际的土地统一登记制度的设立,并提出了平稳过渡、分阶段实施的设想,为下一步不动产统一登记的实施提供决策参考。
Land registration system is an important part of land management system,and the foundation of cadastral management system and the new property law. With the development of market economy,there is increasing awareness of rights protection,and with the proposal of unified real estate registration,the current land registration system needs further perfection,due to its failing to meet the needs of social development. Taking Fuzhou city as an example,the present paper firstly analyses the registration of all kinds of land and the related preparation work of a unified registration system. Then,it demonstrates advantages and disadvantages of uniform registration system based on land. In view of the existing problems,the establishment of a unified registration system is investigated from different aspects,such as scope,legal basis,institution,data updates and the establishment of talent team construction. According to the above analysis,a smooth transition process is presented to provide reference for the implementation of a new real estate registration system.
