摘要
与医药知识产权相关联的健康权是一种公法上的权利。保护健康权与保护医药知识产权既具有一致性,又有矛盾性,实现两者的平衡即是要达到和维护其一致性,克服其矛盾性。本文介绍了健康权的定义和性质、健康权与医药知识产权的关系,探讨如何保持健康权与医药知识产权的平衡关系。
The health rights associated with the pharmaceutical intellectual property are rights in public laws. However, the protection of health rights and the protection of intellectual property are not only consistent, but also contradictory. In order to make balance between health rights and intellectual property, we should achieve and maintain their consistency and overcome the contradiction. This paper introduced the definition and character of health rights and the relationship between health rights and pharmaceutical intellectual property, in order to take a discussion on how to keep balance between them.
