摘要
在产学研结合过程中通常会出现不同形式的争议不仅会影响产学研结合中主体各方的利益 ,而且会给产学研结合造成冲击 ,甚至会对科技进步和成果转化形成阻碍。为预防出现上述争议 ,产学研结合的主体各方特别是知识产权的创造方 ,应增强知识产权保护的意识和能力 ,尊重和维护主体各方的合理利益 ;加强合同管理 ,依法履行合同 ,充分利用社会专业评估和其他中介机构的力量 ,减少知识产权争议 ,保障产学研结合的顺利进行。
There are all kinds of disputes during the combination of industry,university and research,which can have effect not only on each side's benefits,but also on the combination of industry,university and research or even obstruct the progress of science and technology and conversion of the technique achievement.In order to avoid the above disputes,еach cooperator of the combination,especially the creator of the intellectral property should act as the followings:improve the consciousness and ability of protecting the intellectral property,respect and maintain each cooperator's interest;strengthen the management of the contract and carry it out legally;make full use of the power of the professional evaluating organization and other medi-organization in society,reduce the possibility of dispute,ensure the combination carried out successfully.
