摘要
网络传播行为按照时间顺序依次可以分解为 :数字化、上载、传输、下载、浏览等多个过程。版权的板块式保护适合于分类行为时代 ,其保护作品新的使用方式的做法是 :采取按时间拆分、再把拆分后的子过程归类于版权法中已有的权利范畴 ,使用已有的权利组合保护新的使用方式。数字时代作品的使用表现为地域、时间和行为的模糊化。面对作品使用方式的复合化和模糊化 ,板块式版权保护已不具有司法的经济性 ,应建立版权的集成保护 ,即不再采取拆分加归类的保护方式 ,而是为包含数个子过程的使用方式确立一个集成的权利 。
Network transmission can be disassembled chronologically into such processes as digitalization upload transmission download and browse. The orbit copyright protection is adaptive to the era of classifying behavior. But in the digital era when the methods of using products are blurry and integrated, the orbit copyright protection has lost its economical value in judicatory. Instead of using disassembling plus classifying methods we should establish assembling copyright, which means to create an organic copyright for integrated manner including some of individual sub processes.
