摘要
网络环境下,信息网络传播权的设立及《信息网络传播权保护条例》的颁布和实施,使信息资源共享受到了冲击,如何在信息网络传播权保护与信息共享之间建立起动态平衡是一个重要问题。文章借用知识产权界所提出的权利弱化与利益分享理论思想,分析了该理论的合理性。
Under network environment, the establishing of the right of communication through information network and the coming on of regulations for the protection of Information Network Transmission Right, which makes information resource sharing suffer a blow. How to establishing a dynamic balance between the protection of information network transmission right and information sharing is a important question. The paper use what the intellectual property proposed the thought of rights weakening and interests sharing, analysis the rationality of the theory.
