摘要
首先剖析了我国授权立法在授权方 ,被授权方及监督等方面存在的缺陷 ,进而提出并阐述了确立授权立法的基本原则 ,完善授权法的内容、完善授权立法所立法律的内部结构、加强对授权立法的监督。
This article expounds the main existing defects of our delegated legislation in the aspects of authorizing party, the authorized party and supervision, then puts forward and expounds five concrete suggestions of improvement and perfection. The five suggestions include defining delegated legislation, perfecting the act content of authority, perfecting the internal structure of delegated legislation, strengthening the supervision of delegated legislation, and absorbing good experience of western countries' delegated legislation for reference.
