摘要
电子商务对传统商务法律规范产生强大的冲击 ,同时引发一系列新的法律问题。电子商务要求解决其与传统商务法律的冲突。解决两者间冲突的方法是 :统一电子商务法律的基础 ,遵循WTO及国际规则 ,调整和修改传统商务法律 。
Electronic commerce has effected a great challenge to the laws over traditional commerce, giving rise to a series of new legislature problems. There are legislative contradictions between the two types of commerce that need to be defined and settled. A proposal is attempted in this essay for a unified legislative definition of electronic commerce and a modification of the existing business law in accordance with WTO and international practice toward a timely legislation on electronic commerce.
