摘要
建设纠纷是困扰规划管理工作的一大难题 ,从《民法通则》关于相邻权的规定入手 ,探讨了民事法律与规划法律的关系 ,对规划管理现行法律、法规、规范与相邻权问题的关系进行了分析 ,提出了对策。进而引申对规划管理工作现存的主要矛盾、规划法制、规划体制等问题发表了个人意见。
The building conflict, in another word, adjacent right is a headache puzzling the planning administration. This paper discusses the relationship between the civic law and planning administration law. It also analyses the links of the planning administration law, regulations, norms and the adjacent right, putting forward the proposals on the planning system and planning legislation.
