摘要
侦查是刑事诉讼大厦的基石 ,它在整个刑事诉讼活动中起着极为重要的作用。司法实践中 ,非侦查机关、非侦查人员行使、干预侦查权和侦查机关放弃侦查权、滥用侦查权、超越侦查权的现象仍然存在。而解决这一问题的关键在于侦查主体、侦查客体。
Investigation is the foundation stone of the whole criminal procedures in which investigation pays a vital important part.In practice,the phenomena still exist that non-investigative organs,non-investigators exercise and interfere with the investigatory authority,and the investigative organs abandon,abuse and exceed the investigatory authority.The key to the problem is legality of the investigatory subjects,the investigatory objects and the investigatory contents.
