摘要 教育法规地位是一个关涉教育立法理论和实践的重要问题。我们主张教育法的独立性,因为其独特的调整对象——教育关系具有质的特定性,以其为基础形成的"教育法律关系"概念统摄着教育活动中人们所形成的多重复杂的法律关系,其以公民的受教育权益保护作为核心内容,有着多样化、独特化的表现形式,能够在教育与国家的动态平衡中实现与行政法规的相对独立,并与其他部门法一起和谐一致地构成我国的法律体系。 The status of educational law is an important issue relating to the theory and practice of educational legislation. Educational law should be independent in the present law system, because its special regulative object, the educational relationship has the specific nature. The concept of "education legal relationship", which is formed based on educational law, governs multiple and complex legal relationships during people's educational activities. The core content of education legal relationship is protecting citizens" right to education, and the expressive forms of education legal relationship are diverse and unique. Educational law gains independence from administrative law under the dynamic balance between education and our country, and it composes legal system harmoniously together with other branch laws.
