摘要
为适应现代物流业的快速、健康、可持续发展,我国应建立起完善的物流法律法规体系。而目前我国物流立法存在一些问题,包括立法的协调性、权威性、国际化不足以及体系性、配套性欠缺等。通过对国内相关研究文献的梳理,发现现有物流法律法规体系构建理论也存在一定的缺陷和不足。将系统的整体性、结构功能性、层次性、开放性和灵活性融入物流立法中去,以构建物流法律规范系统,可为我国物流法律法规体系建设提供一种新的思路。
China should establish and improve the logistics system of laws and regulations,in order to fit the modern logistics industry developing fast,healthily and sustained. But there are some problems in present logistics legislation in our country,including the lack of coordination,authority,internationalization of legislation,and system and supporting are not enough. At the same time,some defects and deficiencies in present construction theory of the logistics system of laws and regulations exposed through analyses of related literatures. It can provide a new idea for the construction of logistics system of laws and regulations in china by the integration of system＇s entiety,structual function,hierarchy,openness and flexibility in the Logistics legislation.
