摘要
稀有金属矿产资源开发生态补偿对于保护与改善生态环境,促进稀有金属矿产资源的合理开发利用和保护,确保我国稀有金属矿业可持续健康发展,推动矿产资源开发领域生态文明制度建设,具有重要意义。目前,我国矿产资源开发造成的生态问题非常严重,文章以稀有金属矿开发为例,对矿产资源开发生态补偿理论研究进行了回顾与思考,对国内外矿产资源开发生态补偿立法规定及其机制和政策进行了归纳分析,在此基础上提出了我国稀有金属矿产资源开发生态补偿法律制度框架,以期对我国《矿产资源法》的修订、《稀有金属管理条例》的制定和生态补偿法律制度的完善有所裨益。
Ecological compensation of rare metal mineral resources development is of great significance, which can protect and improve ecological environment, promote the rational development and utilization of rare metal mineral resources, ensure the sustainable and healthy development of China＇ s rare metal mining, and promote the construction of ecological civilization system in mineral resources development. At present, our country has got very serious ecological problems caused by mineral resources development. Taking the development of rare metals as an example, this paper reviews and reflects on the theoretical research on ecological compensation of mineral re- sources development, and then makes an analysis and evaluation on ecological compensation legislation, mecha- nism and policy in mineral resources development at home and abroad. On the basis of this, it puts forward a legal system framework of ecological compensation for China＇ s rare metal mineral resources development, with the hope of benefiting the revision of the mineral resources law, the establishment of regulations on the administration of rare metals and the improvement of the ecological compensation legal system.
