摘要
证据交换制度对于保障知识产权诉讼公正、提高诉讼效率具有积极意义。在当前司法实践中证据交换制度存在诸多的问题,严重阻碍该制度发挥应有的功效。我国应当完善证据交换法律体系,健全证据失权的法律保障体系,特别是涉及商业秘密类的知识产权案件需要执行例外规定,以保障该制度的高效运行。
The evidence exchange system is significant to protect intellectual property litigation justice. There are many problems existing in evidence exchange of judiciary, which severely hinders the system in taking its＇ effect. In our country, the legal system of evidence exchange and juristic guarantee system of proof-losing-right should be consummated. Especially, intellectual property cases concerning the business secret need to be executed by exception, ensuring the system run efficiently.
