摘要 目前学界就体育领域集体谈判相关研究尚存劳、资界限不清、相关设想与法律规定相悖,公权力介入等问题亟待解决。在运用劳动分层理论,厘清劳、资谈判需求及界限的基础上,试图构建多方协商机制下的双层集体谈判模式,并分别就谈判周期、主体、内容等进行了探讨。 Nowadays, the distinction between "work" and "payment" is still unclear in the stud- y of collective negotiation in PE circle. Such problems as the assumptions inconsistent with the law and the intervention of authorities need solving soon. Based on labor classification theory, this paper tries to analyze the negotiation needs and to make a clear distinction between "work" and "payment", and proposes to construct the double collective negotiation model by the multi part negotiation and makes a study on the negation cycle, subject and content.
