摘要
农民工群体是我国产业工人的重要组成部分,但在劳动立法及司法实践中仍难以被完全纳入《劳动法》所调整的"劳动者"范围。农民工工伤索赔时除面临"劳动者"身份界定、劳动关系认定障碍外,法律法规、司法解释规定的冲突与分歧也使其在索赔时面临适用法律选择的困境,而工伤赔偿程序中劳动仲裁、行政、民事诉讼交叉问题更加剧了农民工工伤索赔的难度。因此,立法应明确把农民工纳入劳动法的调整范围,摈弃非法用工单位概念,同时改革现行工伤索偿模式,赋予法院直接认定工伤的权力,以解决农民工工伤索赔难题。
The migrant worker group is an important part of modern industrial workers in China, but in labor legislation and judicial practice this group is still difficult to be fully included in the scope of"laborers"in La-bor Law. Except for the obstacles of identity definition and labor relations, conflicts and differences of laws regulations and judicial interpretations also block migrant workers' work-related injury claims. Labor arbitra-tion, administrative, and civil litigation of the compensation program exacerbate the overlapping problem of the difficulty of migrant workers' work-related injury claims. Therefore, legislation should clarify the migrant workers into the regulation range of Labor Law, abandon illegal employment unit concept and reform the mode of work-related injury claim for payment method, give the power with the court to cognize work-related injury directly and solve the problems of migrant workers' work-related injury claims.
