摘要
现代国家广泛参与经济生活 ,并将权力的、公共的意志通过合同的形式加以实现 ,这是市场经济条件下经济合同或政府商事合同的本质和要义之所在。本文从政府采购的概念及其特征着手 ,分析了我国政府采购制度改革的必要性和重要意义 ,以比较的方式 ,对政府采购制度和政府采购合同作了较为系统的研究 ,就我国建立、完善政府采购法提出了相应的对策和建议。作者希望能够以此为中心和起点 ,在新形势下重建我国的经济合同法律制度。在本文研究的基础上形成的《政府采购法 (民间建议草案 )》 ,则可供实际部门立法和学者研究时参考。
The modern governments,participating in the economic areas comprehensively,realise its power and communal wills through various contracts.This is the whereabouts of economic contracts or government comercial contracts' essence under the condition of marketing economy.This article,beginning with the definition and characteristics of government acquisition,analyses the necessity and urgency of Chinese government acquisition reform,carries a systemic research on the legal institution of government acquisition administration and government acquisition contract through a comparative way,and puts forward a series of countermeasures and suggestions to the legislation of government acquisition act in China.The authors hope to process a restatement of the legal institution of econmic contracts under the new situation with the article as the center and starting point.The government acquistition act,as a civilian recommending draft on the basis of research in this article,could be a reference to the legislation of legal practice sectors and the study of scholars.
