摘要
法官自由裁量权是法官在审理案件过程中,根据法律规定和立法精神,秉持正确司法理念,运用科学方法,对案件事实认定、法律适用以及程序处理等问题进行分析和判断,并最终作出依法有据、公平公正、合情合理裁判的权力。中国特色社会主义法律体系形成后,法官在强化法律统一适用的同时,应正确运用司法政策,规范行使自由裁量权,充分发挥自由裁量权保障法律正确实施、推进法治进程中的作用。
Discretion of judge is the power of the judge upholding the right judicial philosophy, using scientific methods,to analyze and judge application of the law and legal procedure,in order to find the fact of the case,according to the law and the spirit of the legislation, and ultimately make a fair and reasonable judgment, during the judicial process of case. With the formation of Chinese characteristic socialist legal system, the judge should strengthen the unified application of law, apply justice policy properly, regulate the discretion of judge, to guarantee proper implementation of law and promote the process of role of law.
