摘要
在行政决策法治化的建设中,对于重大行政决策的范围如何界定一直存在着诸如行政决策难以类型化、重大行政决策事项难以统一、决策程序公众参与度不高等理论和实践上的困境。突破这些困境,首先要区分重大行政决策与一般行政决策的特性,其次在确定重大行政决策事项范围时,还应该从"重大"的价值属性角度来进一步探讨"重大"的判断标准。重大行政决策范围的界定标准应该尽量客观化和标准化,如果放任行政机关对"重大行政决策"范围的自由裁量权,将会极大地损害我国的行政法治建设。
As to the definition of scope of major administrative decision-making, there are some dilemmas in the legalization of ad- ministrative decision, such as the difficulty of categorization of administrative decision-making, the inconsistency of the items of major administrative decision-making and the low degree of public： participation in the decision-making process. To get rid off the di- lemmas, we should first distinguish between the characteristics of major and ordinary administrative decision-makings, and then probe into these standards from the values of the ＂major＂ ones. The scope of major administrative decision-making should be objec- tive and standard as much as possible. Free-wheeling the discretion of the scope of major administrative decision-making could greatly undermine the administrative rule by law.
