摘要
行政案件快速办理程序,是指对不适用简易程序,事实清楚,违法嫌疑人自愿认错认罚,对违法事实、法律适用无异议的行政案件,行政机关可以简化取证方式和审核审批手续.其以新行政法多元化政府治理为基本立场,以反思型法治为规范路径,以程序成本与失误成本的关系衡量为正当性基础.《公安机关办理行政案件程序规定》修订增设“快速办理程序”,依其论证、设立与实施过程归纳其基础构造,即适用范围、程序权利保障规范、调查证据制度创新、程序衔接.程序构造的关键技术包括内部程序的外部化及程序的类型化、全面收集证据原则的例外与独立的证明标准、行政调查与证据形式的多元与可替代性,可为完善行政处罚立法、建构程序法制提供待考的视角.
Rapid handling procedure of administrative cases,which is not applicable to the summary procedure,but the facts are clear,the illegal suspect voluntarily admit guilty to punishment,and no objection to the illegal facts and the law application,the administrative organs can simplify the method of evidence collection and approval procedures.Taking the new administrative law as the basic position of pluralistic government governance,the reflective rule of law as the normative path,and the relationship between procedural cost and error cost as the basis of legitimacy.The revised department regulation has added rapid handling procedure.The basic structure includes the scope,the guarantee norms of basic procedural rights,the innovation of administrative investigation and evidence system,and the convergence of procedures.The key technologies include the externalization of internal procedures and the type of procedures,the exceptionalness of the principle of comprehensive evidence collection and independent certification standards,and the diversity and substitution of administrative investigations and forms of evidence.It could provide a perspective for the construction and perfection of administrative penalties and procedural legislation.
